Regional Housing Authority Attorney

Clear Creek Regional Housing Authority

The selected legal counsel will provide comprehensive legal services to the Clear
Creek Regional Housing Authority (CCRHA) in accordance with applicable
laws, intergovernmental agreements, and housing authority regulations. Services
include, but are not limited to:
1. General Legal Counsel & Governance
• Provide legal guidance to the CCRHA Board of Directors and staff on governance,
compliance, and strategic planning.
• Ensure compliance with federal, state, and local laws, including C.R.S. § 29-1-204.5
(Multijurisdictional Housing Authority Law).
• Draft, review, and interpret bylaws, board policies, and operational procedures.
• Ensure compliance with Colorado Governmental Immunity Act (C.R.S. 24-10-101 et
seq.) and advise on risk mitigation strategies.

2. Land Use, Real Estate & Housing Development
• Provide legal support for real estate transactions, including title review, due
diligence, environmental assessments, and easement agreements.
• Assist with land banking, deed restriction programs, and affordable housing
development.
• Ensure compliance with zoning laws, land use regulations, and historic preservation
requirements.
3. Intergovernmental Agreements & Policy Development
• Draft, review, and interpret intergovernmental agreements (IGAs), ordinances,
resolutions, and housing policies.
• Advise on conflicts between municipal, county, and state regulations affecting the
Authority.
• Ensure CCRHA’s policies are legally sound and aligned with state housing
initiatives.
4. Contracts, Procurement & Regulatory Compliance
• Draft, negotiate, and review contracts, funding agreements, and development
agreements.
• Ensure compliance with procurement laws, public bidding requirements, and conflict
of interest regulations.
• Provide guidance on federal and state funding compliance, including HUD, tax
credits, and grant programs.
5. Financial & Revenue Legal Support
• Provide legal review of funding models, taxation, and impact fees, ensuring TABOR
compliance.
• Assist in structuring public-private partnerships (P3s), tax credit programs, and
alternative funding sources.
• Advise on bond financing, including private activity bonds and conduit revenue
bonds (C.R.S. § 24-32-1703 & C.R.S. § 29-3-103).
6. Employment & Labor Law Compliance
• Advise on hiring, personnel policies, and labor law compliance.
• Ensure adherence to federal and state employment laws, including wage and hour
regulations.
• Provide legal guidance on staff training, workplace policies, and employee disputes.
7. Litigation, Risk Management & Insurance
• Represent the Authority in legal disputes, administrative hearings, and litigation.
• Ensure compliance with governmental immunity protections and liability coverage
(C.R.S. 24-10-101 et seq.).
• Review and advise on insurance policies, indemnification agreements, and risk
management strategies.

8. Public Transparency & Community Engagement
• Ensure compliance with the Colorado Open Records Act (CORA) and public
meeting laws.
• Provide legal guidance on public hearing procedures, public notices, and stakeholder
engagement strategies.
• Assist in developing policies that promote community participation and equitable
housing solutions.
9. Board & Staff Training
• Conduct legal training for the Board of Directors and staff on governance,
compliance, and ethical responsibilities.
• Provide updates on emerging legal trends, legislative changes, and best practices for
housing authorities.
